Dependent Care FSA Limit 2026: $7,500 per Return (Up From $5,000)
Updated · figures checked against the sources below
The 2026 dependent care FSA limit, what it pays for, and whether it beats the child and dependent care credit at your income.
The 2026 dependent care FSA limit is $7,500 a year per tax return ($3,750 if married filing separately), up from $5,000 (26 U.S.C. §129 (dependent care assistance programs)). The One Big Beautiful Bill Act raised it from 2026, and it is a fixed amount, not indexed, so it stays $7,500 in 2027.
| Year | Limit per return | Married filing separately | Basis |
|---|---|---|---|
| 2024 | $5,000 | $2,500 | IRC §129 before the 2025 amendment |
| 2025 | $5,000 | $2,500 | IRC §129 before the 2025 amendment |
| 2026 | $7,500 | $3,750 | IRC §129(a)(2)(A) as amended by P.L. 119-21; not indexed |
| 2027 | $7,500 | $3,750 | IRC §129(a)(2)(A) as amended by P.L. 119-21; not indexed |
The statute now reads that the exclusion “shall not exceed $7,500 ($3,750 in the case of a separate return by a married individual)” (26 U.S.C. §129 (dependent care assistance programs)). It is per return, not per child and not per parent: a married couple filing jointly shares one $7,500 limit even if both employers offer an FSA. It also cannot exceed your earned income or, if married, the lower earner’s. Your employer’s plan may set a lower limit.
Dependent care FSA or the child care credit: which saves more?
Federal income tax and Social Security and Medicare tax from the same 2026 tax engine as the federal income tax calculator; the credit under 26 U.S.C. §21 as amended for 2026. Wages only, standard deduction. Not included: state income tax, and the child tax credit or other credits that share the income-tax limit (the credit here is capped at the income tax before any credit). A married couple must file jointly to take the credit.
Two examples from the calculator. A married couple earning $90,000 and $60,000 with two children and $12,000 of care: the $7,500 FSA saves $2,224 ($1,650 income tax and $574 Social Security and Medicare tax), against a $2,100 credit with no FSA. A head of household earning $32,000 with one child and $6,000 of care: the FSA saves $1,061 against a credit of $788. The FSA avoids payroll tax as well as income tax, which the credit cannot do; the credit can still win at low incomes, where its rate is highest and income tax is small.
The child and dependent care credit for 2026
From 2026 the credit is 50% of up to $3,000 of care costs for one qualifying person or $6,000 for two or more, reduced by 1 point for each $2,000 of AGI over $15,000 until it reaches 35%, then by 1 point for each $2,000 ($4,000 joint) over $75,000 ($150,000 joint) until it reaches 20% (26 U.S.C. §21 (expenses for household and dependent care services)). The $3,000 / $6,000 is reduced dollar for dollar by what you exclude through the FSA, so with two children a full $7,500 FSA leaves no expenses for the credit.
| AGI | Rate | Most, 1 child | Most, 2 or more |
|---|---|---|---|
| $15,000 (single or head of household) | 50% | $1,500 | $3,000 |
| $25,000 (single or head of household) | 45% | $1,350 | $2,700 |
| $43,000 (single or head of household) | 36% | $1,080 | $2,160 |
| $75,000 (single or head of household) | 35% | $1,050 | $2,100 |
| $90,000 (single or head of household) | 27% | $810 | $1,620 |
| $105,000 (single or head of household) | 20% | $600 | $1,200 |
| $150,000 (joint) | 35% | $1,050 | $2,100 |
| $190,000 (joint) | 25% | $750 | $1,500 |
| $210,000 (joint) | 20% | $600 | $1,200 |
What a dependent care FSA pays for
Care for a dependent under 13, or for a spouse or dependent who cannot care for themselves and lives with you more than half the year, so that you (and your spouse) can work or look for work (26 U.S.C. §21 (expenses for household and dependent care services); IRS Publication 503, Child and Dependent Care Expenses). That covers day care, preschool and a nanny or babysitter while you work; before- and after-school care and day camp can count too. Overnight camp does not (the statute excludes it), and neither does school from kindergarten up, summer school or tutoring (IRS Publication 503, Child and Dependent Care Expenses). A dependent care FSA is separate from a health FSA, whose 2026 limit is $3,400: 2026 FSA limits.
Child care is a decade of costs; the plan that pays for it is a forty-year one. QuantCalc runs your whole retirement — Social Security, withdrawals, taxes, health costs and Medicare surcharges — year by year.

What is the dependent care FSA limit for 2026?
$7,500 per tax return, or $3,750 for a married person filing separately (26 U.S.C. §129 (dependent care assistance programs)). It was $5,000 through 2025.
Is the $7,500 dependent care FSA limit per person or per household?
Per return. A married couple filing jointly has one $7,500 limit between them, even with two employers and two FSAs; filing separately, each spouse has $3,750 (26 U.S.C. §129 (dependent care assistance programs)).
Will the dependent care FSA limit change in 2027?
No. The $7,500 is a fixed amount in the statute with no inflation adjustment, so it stays the same until Congress changes it (26 U.S.C. §129 (dependent care assistance programs)).
Can I use a dependent care FSA and the child care credit?
Yes, but not on the same dollars. The $3,000 or $6,000 of expenses the credit can count is reduced by what the FSA excludes (26 U.S.C. §21 (expenses for household and dependent care services)). With one child and a full FSA, nothing is left for the credit.
What is a dependent care FSA?
An employer plan that lets you pay for child or dependent care with pay that is not subject to income tax or Social Security and Medicare tax, up to $7,500 a year from 2026 (26 U.S.C. §129 (dependent care assistance programs); IRS Publication 503, Child and Dependent Care Expenses).
