How the tax is computed
Every step the engine takes for Delaware, in the order it takes them. Steps marked with a filing status or household type apply only there. Each step links the section below that carries Delaware's figures and the official sources for it; the calculation order page describes every step for all jurisdictions.
What each filing status gets, read back from the engine for a household with $1 of income (so below every phase-out and income test):
| Single | Married filing jointly | Married filing separately | Head of household | |
|---|---|---|---|---|
| Rate schedule used | single schedule | joint schedule | single schedule | single schedule |
| Top rate | 6.6% from $60,000 | 6.6% from $60,000 | 6.6% from $60,000 | 6.6% from $60,000 |
| Standard deduction, under 65 | $3,250 | $6,500 | $3,250 | $3,250 |
| Standard deduction at 70 (joint: both 70) | $3,250 | $6,500 | $3,250 | $3,250 |
| Personal exemption | none | none | none | none |
| Age subtractions at 70 (joint: both 70) | $4,500 | $9,000 | $4,500 | $4,500 |
- Combined separate return (two columns on one form) joint returns with each spouse's own amounts given A joint return that gives the spouse's own amounts is also computed as two separate returns on one form: each spouse's own income (the items with no owner, such as interest, gains and Social Security, half each) at that spouse's age and facts, the per-dependent credits divided between the columns the cheapest way. The lower of that and the joint return is the tax; the joint return's lines stay in the breakdown.

Without it one household age applies to both.
engine step (compute_state_tax_detail). Engine convention, no external source: The engine cannot know the second spouse's age unless told. - Blindness and disability, per person only when the caller says a person is blind or disabled The filer is person one; the spouse counts only on a joint return and only when the caller says so (there is no household convention as for age). Where a state lets a disabled person (and, where it says so, a blind one, or one whose spouse is disabled) qualify for its general retirement exclusion before the age, that person is treated as having reached the age for that exclusion only. Of the 42 taxing jurisdictions, these have a blind amount: Arizona, Arkansas, California, Colorado, Delaware, the District of Columbia, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, New Jersey, New Mexico, North Dakota, Oklahoma, Oregon, Utah, Vermont and Virginia; these have none: Alabama, Connecticut, Georgia, Louisiana, New York, North Carolina, Ohio, Pennsylvania, Rhode Island, South Carolina, West Virginia and Wisconsin. A disability route is calculated in Arkansas, the District of Columbia, Georgia, Hawaii, Idaho, Iowa, Maryland, Michigan, New Jersey, Oregon and West Virginia.

Engine convention, no external source: Who is blind or disabled is the caller's statement; the engine has no household convention for it. - Rate schedule and standard deduction by filing status Single uses the single schedule and deduction; married filing jointly the joint ones. Head of household and married filing separately follow the two steps below.

Otherwise the joint schedule with every threshold and the deduction halved (computed as the joint tax on twice the income, halved).

spouseobject), each spouse's own distributions (employer-plan money included), pension, public pension, conversion, wages and military pay; spouse 2's shares are clamped into the household totals and spouse 1 gets the rest. Without a split, in per-person mode, every item is divided 50/50. Social Security is divided by each spouse's own gross benefits where the caller givesspouse.socialSecurityGross, else 50/50; other ordinary income and gains are always divided 50/50 where a rule needs a per-person amount. The split is used only where a state's rule is per taxpayer; household totals stay authoritative for the base and the income tests.
engine step (compute_state_tax_detail). Engine convention, no external source: Equal attribution is the neutral split when the owner of a dollar is not known. - Keeping the per-spouse shares inside the household joint returns with each spouse's own amounts given After the public-pension and employer-pension carve-outs, if the two spouses' remaining shares add up to more than the household's exclusion-eligible distributions (an inconsistent split), spouse 1's share is reduced so they do not.
engine step (compute_state_tax_detail). Engine convention, no external source: Input normalisation. - Military retirement pay The state's military rule runs first, on military pay alone, per taxpayer: each spouse's own pay at their own age when attributed, otherwise half each at the household age on a joint return. Exempt dollars leave the base; the rest become pension dollars for the general retirement rules. Where the state lets a disabled retiree qualify at any age, a disabled person is treated as having reached the rule's age.

Per-return states (and the pooled-if-both-qualify rule when both qualify) apply the joint cap to the couple's pooled eligible dollars when either spouse qualifies. Married filing jointly uses the same thresholds as single.
Head of household uses the single schedule.
Married filing separately: one schedule applies to every filing status, so the engine uses it unscaled with the single deduction.
Source review notes (what the sources do not state outright, or what the engine does not carry):
- The rate schedule itself is not extractable as text from the PIT-RES instructions PDF; the statute is the source for rates.
- Delaware Code Title 30, Chapter 11, Subchapter I (30 Del. C. § 1102), Delaware General Assembly, Legislative Council. For taxable years after 2013, Delaware taxes income over $2,000 at 2.2% rising through 3.9%, 4.8%, 5.2% and 5.55% to 6.6% above $60,000, with one schedule for every filing status. Checked 2026-10-12.
- Delaware Individual Income Tax Return Resident Instructions 2025 (PIT-RES), Delaware Division of Revenue. Tax is computed from the tax table below $60,000 of taxable income and from the tax rate schedule at $60,000 or more. Checked 2026-10-12.
Deductions, exemptions and credits
- Standard deduction (or the exemption the engine carries in its place): $3,250 single, $6,500 married filing jointly, and the single amount for head of household.
- Nonrefundable credit of $110 per exemption (one for single, two for MFJ).
- Delaware Code Title 30, Chapter 11, Subchapter II (30 Del. C. §§ 1105-1118), Delaware General Assembly, Legislative Council. The standard deduction is $3,250 for an individual and $6,500 for a joint return (§ 1108(a)), and residents get a $110 nonrefundable personal credit per exemption (§ 1110(b)). Engine 1.7.0: 30 Del. C. §1110(b)(1): a $110 personal credit per dependent; §1106(b)(3): under 60, pensions from employers and governments up to $2,000 (one exclusion per person; IRAs and disability pay do not qualify); §1106(b)(2): $2,000 for a person 60+ or totally and permanently disabled with earned income under $2,500 and income at most $10,000 (joint: $4,000 when both qualify, $5,000 / $20,000). Checked 2026-10-12.
- Delaware Individual Income Tax Return Resident Instructions 2025 (PIT-RES), Delaware Division of Revenue. The 2025 return uses a $3,250 standard deduction (filing status 1) and $6,500 (joint), and a $110 personal credit per person. Checked 2026-10-12.
- Delaware Division of Revenue: PIT-RES_Instructions_2025-01.pdf, Delaware Division of Revenue (archived copy). Earned income credit (engine 1.12.0): 20% of the federal EIC nonrefundable, or 4.5% refundable, the larger after the tax limit. Checked 2026-09-28.
Age 65+ subtractions and credits
- At age 65 or older: $2,500 is subtracted from the base ($5,000 for a married couple filing jointly when both qualify), against any income. With the spouse's age given, each spouse qualifies on their own age.
- An additional nonrefundable credit of $110 per taxpayer at age 60 or older.
Source review notes (what the sources do not state outright, or what the engine does not carry):
- The additional $2,500 deduction applies only to non-itemizers; the engine always applies it (engine has no itemizing path for DE).
- Delaware Code Title 30, Chapter 11, Subchapter II (30 Del. C. §§ 1108(b), 1110(b)), Delaware General Assembly, Legislative Council. A taxpayer 65+ adds $2,500 to the standard deduction (§ 1108(b)); each resident 60 or over gets an additional $110 personal credit (§ 1110(b)(2)). Checked 2026-10-12.
- Delaware Individual Income Tax Return Resident Instructions 2025 (PIT-RES), Delaware Division of Revenue. Filers 65+ who do not itemize add $2,500 to the standard deduction, and each filer or spouse 60 or over on December 31 claims an additional $110 personal credit. Checked 2026-10-12.
IRA, 401(k) and private pensions
- Retirement distributions, Roth conversions and net long-term capital gains together: up to $12,500 excluded per taxpayer ($25,000 on a joint return) at age 60 or older.
- Joint returns: the cap is per taxpayer. With the spouse's age given (couples), each spouse's own dollars are tested against that spouse's own age and cap; without it one household age applies and the $25,000 joint cap covers pooled income.
Source review notes (what the sources do not state outright, or what the engine does not carry):
- The engine reads ordinaryIncome (the API's interest, non-qualified dividends and so on) as eligible retirement income; ordinary income that is not investment income belongs in wages.
- Delaware Code Title 30, Chapter 11, Subchapter II (30 Del. C. § 1106(b)(3)), Delaware General Assembly, Legislative Council. For tax years 2022 through 2026, a person 60 or older may exclude up to $12,500 of pensions plus eligible retirement income (qualified-plan, 401(k) and 457 distributions, dividends, capital gains, interest and net rental income).
Each taxpayer 60 or over gets one exclusion equal to the lesser of $12,500 or pension plus eligible retirement income; spouses each claim their own, and early distributions (code 1 or penalized) do not qualify. Checked 2026-10-12.
- Delaware Division of Revenue: PIT-RES_Instructions_2025-01.pdf, Delaware Division of Revenue (archived copy). Checked 2026-09-28.
- 2025 PIT-RES instructions (filing status 4 and line 6), Delaware Division of Revenue. Eligible retirement income for the 60+ exclusion includes interest and dividends. A married couple may file filing status 4, two separate returns on one form, each spouse reporting their own income and half of jointly titled income; the $110 dependent credits are split between the columns. Engine 1.8.0 pools ordinaryIncome and computes filing status 4 when the spouse's own amounts are given. Checked 2026-09-28.
Public pensions
No separate treatment: public pensions follow the rules for other retirement income above.
- Delaware Code Title 30, Chapter 11, Subchapter II (30 Del. C. § 1106(b)(3)), Delaware General Assembly, Legislative Council. Pensions from the United States, Delaware or its subdivisions share the same $12,500 (age 60+) exclusion as private-employer pensions; there is no separate public-pension exemption. Checked 2026-10-12.
Military retirement pay
- Below age 60, up to $12,500 of military retirement pay is exempt per taxpayer. From age 60 there is no separate military exemption: the pay is pension income under the general retirement rules above.
- Military pay the military rule does not exempt is pension income under the general retirement rules.
- Rules are applied per taxpayer at that person's own age when the spouse's age is given. API value:
rules.militaryRetirement.treatment: "capped_exclusion".
- Sc02, Delaware Code. Up to $12,500 of a US military pension is excluded, per spouse on a joint return; at 60 and older it falls within the general $12,500 pension exclusion. Checked 2026-10-12.
Roth conversions
A conversion counts toward the same per-taxpayer pool as retirement distributions and capital gains; the part of the pool above the cap is taxed.
Source review notes (what the sources do not state outright, or what the engine does not carry):
- No Delaware source addresses Roth conversions explicitly; eligibility of a conversion for the 60+ exclusion is the engine's reading of the eligible-retirement-income definition.
- Delaware Individual Income Tax Return Resident Instructions 2025 (PIT-RES), Delaware Division of Revenue. Delaware starts from federal AGI, so a Roth conversion is income; at 60+ it counts as eligible retirement income (a qualified-plan distribution) toward the $12,500 exclusion, since only code-1 or penalized early distributions are disqualified. Checked 2026-10-12.
Capital gains
- Net long-term gain is taxed as ordinary income.
- Short-term gains are ordinary income.
- Delaware Individual Income Tax Return Resident Instructions 2025 (PIT-RES), Delaware Division of Revenue. Capital gains enter Delaware income through federal AGI and are taxed at the regular rates; at 60+ net capital gains count as eligible retirement income toward the $12,500 exclusion. Checked 2026-10-12.
- Delaware Code Title 30, Chapter 11, Subchapter II (§1105, resident taxable income), State of Delaware. The state return starts from federal adjusted gross income (federal taxable income in CO, IA, ND), so the federal capital-loss deduction (up to $3,000, $1,500 married filing separately) and its carryover are in the state base (engine 1.9.0: cap_loss_limit). Checked 2026-10-12.
- 2025 PIT-RES Instructions, Delaware Division of Revenue. Delaware's eligible retirement income holds capital gains net of capital losses, so a loss lowers the pool the pension exclusion is taken from (engine 1.9.0: retirement-pool-loss). Checked 2026-10-12.
- 2025 Schedule D (Form 1040), Capital Gains and Losses, Internal Revenue Service. The federal return deducts a net capital loss up to $3,000 ($1,500 married filing separately) on Form 1040 line 7a; a state that starts from federal adjusted gross income or federal taxable income carries that deduction. Checked 2026-10-12.
Blindness and disability
- An extra exemption of $2,500 for each person who is blind (the filer, and the spouse on a joint return).
- The API applies these through its
blind,disabled,spouse.blindandspouse.disabledfields; absent means false.
- 30 Del. C. 1108, Delaware General Assembly. $2,500 more for each blind taxpayer, stacking with the 65+ amount. Checked 2026-10-12.
- 2025 PIT-RES instructions (archived copy), Delaware Division of Revenue. The additional standard deduction: $2,500 per condition, $5,000 for a person 65 or older and blind. Checked 2026-09-28.
Part-year and nonresident returns
- Part-year resident (PIT-NON): the tax a full-year resident would owe on all the year's income, times the state's income ratio.
- Nonresident (PIT-NON): the tax a full-year resident would owe on all the year's income, times the state's income ratio.
- The ratio: the state's own AGI (after its subtractions) of the state's income over the state AGI of the whole year, rounded to 4 places, at most 1.
- The Column B pension exclusion is the full exclusion × the Column B share of pension and eligible retirement income.
- A nonresident's retirement income is not taxable by the state (4 U.S.C. §114); the API refuses it in
residency.stateIncome. The credit for tax paid to another state and the earned income credits on these returns are not computed.
Married couples whose residency differs (engine 1.13.0)
With residency.spouse on a joint request, each allowed treatment is calculated and reported in residency.couple; tax is the required one, else the state's default, else the couple's residency.election, else the joint return the request's mfj names. Each rule is quoted from the state's instructions (engine 1.14.0: and its statutes, regulations, bulletins and other official guidance) in the sources below.

After 2026: how the amounts move
A request with projection (API) estimates a later tax year from these rules: every
dollar amount and age test below moves the way Delaware's law moves it. Rates and the rules themselves stay the 2026 ones
(how projection works).
| Amounts (engine fields) | After 2026 | What the law says, and the source |
|---|---|---|
brackets_single (the single rate schedule's thresholds), brackets_mfj (the mfj rate schedule's thresholds) | Fixed in law: held at the rules-year amount in every later year. | For taxable years after 2013 the schedule (0% to $2,000, 2.2%, 3.9%, 4.8%, 5.2%, 5.55%, 6.6% over $60,000) is nominal in 30 Del. Enacted for later years, not applied by the projection
- 60+ military pension exclusion becomes the greater of the $12,500 pension exclusion or $15,000 (2027) / $20,000 (2028) / $25,000 (2029+) of U.S. military pension. (2027-2029+)
- 30 Del. C. § 1106(b)(3) (Title 30, Chapter 11, Subchapter II) (Delaware Code Online (Delaware Legislative Council), statute): 60+ military route. Quoted: "2. for persons age 60 or older, the greater of: a. amounts received, not to exceed $12,500". Checked 2026-10-12.
What the engine does not calculate, and known approximations
- ordinaryIncome is read as interest, dividends and other investment income: at 60 or over it counts toward the $12,500 exclusion with pensions, IRA distributions and gains (engine 1.8.0), split half and half between spouses. Ordinary income that is not eligible retirement income (business income, for example) belongs in wages, where it is not pooled.
- With a spouse split, jointly held long-term gains are attributed half to each spouse.
- Filing status 4 (combined separate) is computed only with the spouse object, and the lower of it and the joint return (filing status 2) is the tax. Each spouse's own wages and retirement income are theirs; the items without an owner (ordinaryIncome, gains, Social Security) are split half and half, as the instructions do for jointly titled property, and the $110 dependent credits go to the column that can use them. Without the spouse object a joint request is a joint return.
What the engine does not calculate for any state (itemized deductions, credits beyond those listed, part-year residents, and more) is listed on the calculation order page.

Social Security
Social Security benefits are fully exempt: none of the federally taxable amount enters the state base.
API value:
socialSecurityRule: "exempt". The engine's input is the federally taxable amount; income tests use the sum of the income components as the adjusted-gross-income proxy.
